2.1. Unless otherwise stated, DEF Hero or its licensors own all intellectual property rights in and to the website and all material contained within it. All such rights are reserved.

3.1. You are expressly prohibited from:

4. SMS Messaging Consent and Communications
4.1. By entering your phone number anywhere on this website, including during checkout, you consent to receive transactional and promotional text messages from DEF Hero. These may include order confirmations, delivery updates, customer support messages, reorder reminders, special offers, and other communications related to our products and services.
4.2. Message & data rates may apply. Message frequency may vary.
4.3. You may opt out at any time by replying STOP to any text message we send. After opting out, you will no longer receive SMS communications unless you initiate contact again or provide new consent.

4.5. Consent to receive text messages is not a condition of purchase.
4.6. You agree that the phone number you provide belongs to you and that you are authorized to grant permission to receive SMS communications.
4.7. DEF Hero is not liable for delayed or undelivered messages, carrier filtering, or service interruptions caused by your wireless provider.
5. Limitation of Liability
5.1. In no event shall DEF Hero or its suppliers be liable for any damages (including, without limitation, loss of data, loss of profit, business interruption, or consequential, incidental, indirect, special, or punitive damages) arising from the use or inability to use the materials on DEF Hero’s website or any products sold by DEF Hero, even if DEF Hero has been advised of the possibility of such damages.
6. Pump Limited Warranty (EPLD & EPHD Pumps)
6.1. Limited Warranty. DEF Hero warrants that its EPLD and EPHD pumps will be free from manufacturing defects in the electrical components that prevent the pump from operating upon its initial installation and first use.
6.2. Initial Operation. Once the pump has been successfully operated during its initial installation and first use, the Limited Warranty for electrical functionality is deemed satisfied. Any subsequent pump failure is presumed to result from operational, environmental, installation, maintenance, misuse, contamination, or other non-manufacturing causes unless DEF Hero determines otherwise following inspection.
6.3. Warranty Exclusions. This Limited Warranty does not cover, and DEF Hero shall have no obligation to repair, replace, or reimburse for failures resulting from, including but not limited to:
Exposure of electrical components to Diesel Exhaust Fluid (DEF), water, chemicals, or other liquids.
DEF spills, overspray, leaks, or contamination affecting the motor, wiring, switch, electrical connections, or other electrical components.
Improper installation, wiring, incorrect voltage, inadequate power supply, or failure to follow installation instructions.
Normal wear and tear.
Abuse, misuse, negligence, accidental damage, impact, freezing, corrosion, or environmental conditions.
Unauthorized modifications, repairs, or disassembly.
6.4. Warranty Claim Procedure. If a customer experiences a pump failure after delivery, the customer must purchase a replacement pump at DEF Hero’s then-current selling price. The original pump must be returned to DEF Hero for inspection, freight prepaid unless otherwise authorized by DEF Hero.
6.5. Inspection and Credit. If, after inspection, DEF Hero determines in its sole and reasonable discretion that the returned pump failed due to a manufacturing defect covered by this Limited Warranty, DEF Hero will issue a credit or refund equal to the purchase price of the replacement pump (or otherwise reimburse the customer in an equivalent amount). If the inspection determines that the failure resulted from contamination, improper installation, misuse, environmental conditions, normal wear and tear, or any other excluded cause, no credit, refund, or reimbursement will be provided.
6.6. Final Determination. DEF Hero reserves the exclusive right to inspect all returned pumps and determine whether a warranty claim is valid. DEF Hero’s determination regarding the cause of failure and warranty eligibility shall be final.
6.7. Exclusive Remedy. The remedies described in this Section constitute the customer’s sole and exclusive remedy for any pump warranty claim. DEF Hero disclaims all other express or implied warranties, including any implied warranties of merchantability or fitness for a particular purpose, to the fullest extent permitted by applicable law.
7. Governing Law
7.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the purchase or use of DEF Hero products shall be brought exclusively in the state or federal courts located in Cook County, Illinois, and the parties consent to the jurisdiction of those courts.
8. Changes to These Terms
8.1. DEF Hero reserves the right to modify or replace these Terms at any time. Changes take effect immediately upon posting to this website.
